Welcome to Aarees, operated by Gesports Pvt Ltd ("we," "us," or "our"). By accessing or using aarees.com and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using any part of the Service, you confirm that you are at least 16 years of age, have read and understood these Terms, and agree to be legally bound by them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Aarees is an AI-powered platform that provides content creation tools including AI thumbnail generation, content analysis, and related services. Features and functionality may change over time at our sole discretion.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of any third party
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service to generate content that is illegal, defamatory, obscene, or harmful
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Use automated means to scrape, crawl, or extract data from the Service without our consent
• Resell or commercially exploit the Service without our written permission

5. Intellectual Property

5.1 Our Content

The Service and its original content, features, and functionality are owned by Gesports Pvt Ltd and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

5.2 Your Content

You retain ownership of content you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display your content solely as necessary to provide the Service to you.

5.3 AI-Generated Content

Content generated by our AI tools is provided to you for your use. You are responsible for ensuring that your use of AI-generated content complies with applicable laws and does not infringe third-party rights.

6. Membership, fair use and Boost

Aarees is a monthly or yearly membership. Two plans: Aarees and Aarees Unlimited. Prices are shown on aarees.com and include GST. Payment is through Razorpay; membership starts when payment is confirmed and renews until you cancel.

Everyday use (chat, documents, translation, planning, reminders) is unlimited on every plan, subject to fair use. Heavy work (images, clips, video, research, bookings) draws on a window that refills every few hours; when the window is empty Aarees tells you a time to come back. Video has a weekly or daily cap by plan. Boost is a one-time add-on that adds a fixed budget of heavy work for 30 days and bypasses the window.

Founding members pay a locked yearly price for as long as they remain members without a gap. Plan limits (window sizes, caps) may be tuned over time; the price you pay does not change during a paid period.

If a task fails you are not charged for it. Aarees never sends you messages you did not ask for, except reminders and scheduled tasks you set up; reply STOP to cancel them.

7. Refund Policy

Unless required by applicable law, payments are non-refundable. If you believe you have been charged in error, contact us at support@aarees.com within 7 days of the charge.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violation of these Terms. You may terminate your account at any time by contacting us at support@aarees.com. Upon termination, your right to use the Service ceases immediately.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Gesports Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Gesports Pvt Ltd and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Third-Party Services

The Service may integrate with or link to third-party services. We are not responsible for the availability, content, or practices of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
